Terms of Service

Thumbar helps you spot possible recall matches. You remain responsible for checking the notice and deciding what to do in your store. Early access is free.

1. Who these terms are for

These proposed terms cover Thumbar's early-access website and recall-monitoring service for US businesses. You must be at least 18 and authorized to act for the business and stores you connect. In these terms, “you” means that business and “we” means the operator of Thumbar.

The operator's legal name and contact details will be confirmed before these terms take effect. Reading this draft does not record your agreement.

2. What the service does

Thumbar compares the product information you provide or authorize us to read with public government recall notices. It shows findings, supports your review decisions and keeps activity records. Email alerts depend on a configured recipient, the alert settings and any review hold. Uploaded lists and manual items are available only where enabled.

Square catalog access is read-only. Thumbar does not remove products from sale, change your Square catalog or inventory, contact your shoppers, or file anything with a government agency on your behalf. It is independent of Square and the government sources.

3. Email notifications

Recall alert emails are sent from Thumbar <alerts@thumbar.app> through our email provider, Fastmail, to the alert address configured for your store. You can change that recipient in Settings. Add this sender to your contacts or allowed-sender list and keep your address current.

Recall alerts are service messages about your store, not a marketing subscription. Emails can be delayed, filtered into spam or missed; check your dashboard as well. Successfully disconnecting or removing a store stops monitoring and new alerts; emails already in transit may still arrive.

4. Check the notice, then your shelf

A match is a reason to investigate, not proof that your particular unit or lot is affected. No match is not an all-clear. Data may be incomplete, outdated or wrong; names and barcodes may not match; notices, checks and emails can be delayed or missed.

Check the coverage and last-check information shown in the service. An unavailable or disabled source is not covered. Some sources are checked on a daily schedule; this is not an immediate-alert or emergency service.

Read the original notice, compare its product, lot, date and location details with your stock, and follow the applicable instructions. Keep your usual supplier and recall checks. You remain responsible for your products, store decisions and legal duties. Thumbar does not provide legal, medical or compliance advice, certification, insurance or a guarantee of complete recall coverage.

5. Your account and information

Keep your login secure, your catalog current and your alert address accurate. Tell us if you suspect unauthorized access or a missed or incorrect finding. Only connect stores and submit information you are entitled to use. Do not upload shopper lists, payment details, health information or other unnecessary personal information. Avoid personal details in review notes.

You keep your rights in the information you provide. You authorize us to process it only to provide, maintain, secure and support the service as described in the Privacy Notice. We do not sell your store data or use it to train AI models. Square and your sign-in provider have their own terms; authorizing Thumbar does not change those terms.

Do not misuse another person's account, bypass access controls, disrupt the service or use it unlawfully. You may use and export your own reports for your business. Government notices and third-party materials remain subject to their applicable rights.

6. Free early access

Nothing is billed during early access.

Early access does not automatically become a paid subscription. Any future paid offer will state its price and terms and require your agreement before charges begin. Features may change or be withdrawn during early access.

7. Stopping the service

You may stop using Thumbar at any time. Use Settings to disconnect a Square store or remove a store created from a file. Contact us for account closure. Store removal and account closure are different actions; the Privacy Notice explains deletion and retained records. Export records you need before removing a store.

We may restrict or suspend access when reasonably needed to address misuse, security threats, legal requirements or a provider's loss of access. We may end early access. Where practicable, we will give notice and a reasonable opportunity to retrieve your records; urgent security or legal issues may require immediate action. Monitoring and alerts stop when the relevant access or service ends.

8. Service limitations and responsibility

To the extent the law allows, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise uninterrupted access, accurate or complete findings, successful email delivery, or prevention of loss.

To the extent the law allows, neither party is responsible to the other for indirect or consequential losses, including profits lost as an indirect or consequential result, arising from use of the service. This does not exclude or limit responsibility for fraud, gross negligence, willful misconduct, violations of law or any liability or remedy that cannot lawfully be excluded or limited. It does not waive your mandatory privacy or other statutory rights.

9. Changes, questions and disputes

We will identify the version and effective date of final terms and give reasonable advance notice of material changes, except when a legal or urgent security need requires a shorter period. Changes apply prospectively. We will obtain agreement where required; simply editing a page does not create your acceptance of new terms.

Contact alerts@thumbar.app with questions or a dispute. These draft terms do not require arbitration, waive class actions or choose a court or governing state law. Mandatory legal rights remain available. If a provision cannot be enforced, the remaining provisions continue to the extent permitted by law.
